ReVamp Challenge Rules & Regulations for Entry:
We want you to have fun with the Revamp challenge, but we also have to clearly spell out the challenge rules. We apologise for their length in advance.
1. Challenge Period: REVISED September 18, 2009 starts at 12:01 am EST on April 24, 2009 and continues until 11:59 pm EST on DECEMBER 31, 2009, the “Challenge Closing Date”. Viewer's choice voting begins January 1, 2010 and closes on or about January 15, 2010. No purchase is necessary. Only three (3) entries per person in only one chosen category per person are allowed. Any attempt or suspected attempt to enter more than thrice per person, any use of robotic, automatic, programmed or entry methods not authorized by these rules, shall be deemed as tampering and will void all of your entries. All times are Eastern Standard Times. The sole determinant of time for the purposes of receipt of a valid entry in this Contest will be the Contest server machine(s).
a. To enter, go to www.janome.ca/revamp to complete the online entry in full and submit it as instructed by the Challenge Closing Date and informed by the ReVamp Challenge Rules and Regulations listed herein.
2. The Entrant: Is deemed to be the person who is named on the official ReVamp Challenge entry submission. This person is also she/he who is solely responsible for creating the Revamped entry piece referred to as the “unique creation” (with the exception of Jr. Trendsetters', who may have limited assistance from teachers, parents or others in the position of teaching the Entrant).
- Entrants in the Junior Trendsetter category may enter only with parental/guardian permission. This permission will be confirmed at the time of the awarding of prizes. Janome Canada Ltd. is not responsible for the unauthorized entry of minors into this challenge.
3. Original Textile: The Original textile is that item that will be reused and repurposed to create the new, “unique creation.” This could be termed your inspiration piece and would have been a fabric based item or garment that was used for a previous purpose.
4. “Unique Creation:” To be deemed a “unique creation”, the submitted entry must have been completely created by the Entrant of note. The Entrant may make use of copyrighted patterns or teaching methods so long as these patterns or methods are duly noted, credited and used within the guidelines established by the original pattern designer, company or teacher. Janome Canada Ltd. does not oversee this authorized use and is in no way responsible or liable for its enforcement.
5. Registration Policy: Registration is required for the use of certain portions of the Websites. In order to register, you must supply, among other things, a valid email address and a password of six characters or more (“Registration Information”). Once you register, you will be given access to a unique account (your “Account”) through which you may access the various features of the Websites. It is your responsibility to keep your Registration Information secret. You agree to immediately notify Janome Canada Ltd. if you believe that your Registration Information has been, or will be, compromised.
- Your registration with the Websites shall not impose any duty on Janome Canada Ltd. to provide any particular service to you.
- Janome Canada Ltd. reserves the right to terminate your Account for any reason in our sole and absolute discretion at any time, without prior notice to you.
- Janome Canada will have complete and unfettered access to your account and may modify content as deemed appropriate and in line with the website's Terms and Conditions of Use.
- By entering the ReVamp Challenge, participants agree to the use of their entry images in any promotion, campaign, advertising collateral or Janome dealer network communications and promotional materials as deemed appropriate by Janome Canada Ltd. and its related affiliate companies.
- By entering the ReVamp Challenge, Entrants agree to the loan of their winning entry to Janome Canada Ltd. for a period of approximately one year. Their winning entry will be displayed at Janome events, at Janome Dealerships and online at www.janome.ca. All reasonable care will be taken to provide for the safe return of their undamaged entry. Should the entry become damaged while in the care of Janome Canada Ltd., a replacement award of up to $250 will be provided to the entrant in the form of cash, product or a mutually agreed upon award. (This award will be made in consideration of any third party claims, such as through authorized shipping agents).
6. Judge's Choice Criteria: Among all qualified entries received, the judging panel (the "Judges") assigned by Janome Canada Ltd. shall select the top entries per category based on their Informed Review of the submission. All judges' selections will be combined by authorized Janome Canada Ltd. staff to determine the final winners in each category as well as the Grand Prize Winner. Criteria for informed review include:
a. Appropriate and significant use of the “original textile” in a new and unique creation.
b. Priority consideration will be given to those submissions that make use of the original textile in at least 50 percent of their original creation.
d. Any challenge to the rights of an entry in dispute may cause the entry to either be permanently or temporarily removed from the ReVamp Website until its resolution.
e. Qualities of the Judges' Informed Review include, but are not limited to: ingenuity, originality, manipulation of the original textile, employment of sewing techniques and the overall visual appeal of the entry. Consideration will also be given to the presentation of the entry in photos and the entrants' statement.
7. Viewer's Choice process: the Viewer's choice determination will be made by a tally of electronic submissions as determined by the appropriate software employed by the ReVamp website.
- Only one viewer's choice vote is allowed per category.
- In order to be eligible to vote, participants must register for an account without regard to entering the challenge. (Entrants may vote in all categories, including their own).
- Viewer's Choice voting will only be open for a limited time from January 1 -15, 2010.
8. Winning: On or about January 31, 2010, The Viewer's Choice and Judge's Choice selections will be tabulated and winning entrants will be determined at the office of Janome Canada Ltd., Mississauga, ON. Selected entrants will be contacted by telephone or email, as set out in the online entry.
- To be declared a winner, selected entrants must first correctly answer, unaided, a time-limited, mathematical skill-testing question posed by telephone at a mutually convenient time; and will also need to return a signed release of liability and acknowledgment form. Contest judges' rulings are final and without appeal in all matters related to the promotion and the awarding of prizes.
- Entrants consent to the use of their entry, name, city of residence and/or any photograph of or that may be taken in publicity carried out by Janome without further notice or compensation.
- If the identity of an entrant is disputed, the authorized account holder of the e-mail address submitted at the time of entry will be deemed to be the entrant. The individual assigned to the e-mail address for the domain associated with the submitted e-mail address is considered the authorized account holder. A selected entrant may be required to provide proof that he/she is the authorized account holder of the e-mail address associated with the selected entry. All entries must be submitted from a valid e-mail account that may be identified by reverse domain name search.
9. Prizes: Entrants are eligible to win:
_ Prize award schedule may be redistributed, dependent on the number of qualified entries received, at the sole discretion of Janome Canada Ltd.
- One (1) Grand Prize, having an approximate retail value of $2,000 and consisting of an MC200E Embroidery machine, a CD collection of 500 embroidery designs by Stitchitize Canada, and a Janome embroidery thread collection
- one of four Judge's Choice prizes of an FM725 felting machine valued at $599.00 each (based on minimum number of entrants)
- One of four Viewer's Choice $100 cash prizes (based on minimum number of entrants)
- Entrants may win more than one prize if their entry is chosen in multiple categories.
- If the selected entrant cannot be reached within 5 days, incorrectly answers the skill-testing question, declines the prize, or fails to return a Release of Liability, another entrant will be selected.
- Prize must be accepted as awarded and may not be transferred or exchanged. Janome reserves the right to substitute a prize of at least equal value in the event of the unavailability, for whatever reason, of the advertised prize.
- Janome Canada reserves the right not to award all prizes in the event an insufficient number of eligible entries meeting the minimum judging criteria are received, as determined by Janome Canada in their sole discretion.
10. Publicity Release: By entering the Challenge, Entrants agree to a general publicity release. Prize winners may be posted on the website on or about January 31, 2010, pending the receipt of their winning Revamp entry project. Winners consent to the use of their name, place of residence, voice, statements, and photographs or other likenesses, as well as affiliated schools' or dealerships' listing if applicable, for publicity, advertising or informational purposes in any medium or format without further compensation or notice. (Publicity Release not required where prohibited by law.)
11. Claiming Prizes: The winning entrant must sign and return an Affidavit of Eligibility and Liability Release within ten (10) days of notification, or his or her prize may be forfeited. Prizes will be delivered to each winner's residence within thirty (30) days of receiving the Affidavit of Eligibility and Liability Release.
12. Eligibility: This Contest is open to residents of Canada, with the exception of the Province of Quebec, excluding employees of Janome Canada Ltd., its dealers and agents, affiliated artisans and judges. The Contest is subject to all applicable federal, provincial and municipal laws and regulations.
- Entrants in the Junior Trendsetter category do so with parental/guardian permission only. This permission must be confirmed in order to win.
- All entries that are incomplete, irregular, have been submitted through illicit means, or do not conform to or satisfy any condition of the rules may be disqualified by Janome. Janome takes no responsibility for lost, stolen, delayed, damaged, misdirected, late or destroyed entries, or for typographical or other production errors. Janome is not responsible for any errors or omissions in printing or advertising this Contest. All online entry photos become the property of Janome.
13. By entering this Contest, entrants release and hold harmless Janome Canada Ltd., the Contest judges, their affiliates and respective directors, officers, owners, partners, employees, agents, dealers, representatives, successors and assigns (collectively the “Releasees”) from any liability in connection with this Challenge or, if declared a winner, the prize(s). Before being declared a winner, entrants may be required to sign and return, within a stipulated period of time, a Declaration of Compliance with the Contest Rules and a full Liability
14. This Challenge will be run in accordance with these rules, subject to amendment by Janome Canada Ltd. Entrants must comply with these rules, and will be deemed to have received and understood the rules by participating in the Challenge. The terms of this Challenge, as set out in these rules, are not subject to amendment or counter-offer, except as set out herein.
15. Janome Canada Ltd. assumes no responsibility for failure of the internet or the website during the promotional period, for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, access providers, computer equipment, software, failure of any email or traffic congestion on the internet or at any website, or any combination thereof including any injury or damage to an entrant's or any other person's computer related to or resulting from playing or downloading any material in the promotion. Janome reserves the right, in its sole discretion, to cancel or suspend this Challenge should a virus, bug or other cause beyond their reasonable control corrupt the security or proper administration of the Challenge. Any attempt to deliberately damage any web site or to undermine the legitimate operation of this promotion is a violation of criminal and civil laws. Should such an attempt be made, Janome reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.
16. Any litigation respecting the conduct of this Challenge will be determined in the Province of Ontario at the appropriate judicial body in or about the city of Mississauga.
17. Privacy Policy: Janome is collecting personal data about entrants for the purpose of administering this Challenge. No further informational or marketing communications will be received by entrants unless entrants provide Janome with explicit permission to do so as indicated on the entry form. Our policy towards maintaining the privacy and security of user information is to maintain your trust by only communicating with you when you give us permission to (such as with newsletters), always allowing you to opt out of such communications and not handing off your private information to any third party vendors.
